Jurisprudential Differences in the Age of the Holy Prophet (SAW) and His Companions: A Research Study
عہد رسالت مآب ﷺ اور عہد صحابہ کرام ؓ میں فقہی اختلاف:تحقیقی مطالعہ
Abstract
One of the major problems facing the Muslim Ummah today is the issue of " disagreement" between individuals of the Ummah, parties, governments and religions. These disagreements sometimes escalate to the point of factionalism, this factionalism leads to mutual enmity and this enmity becomes a means to reach mutual war, and sometimes it even takes on a religious color and title, for which the texts of revelation are used with justification and interpretation or the testimony is obtained from the affairs and circumstances of the Salaf-e-Saliheen of the Ummah.Disagreement is basically a legitimate thing on which there are numerous arguments from the Qur'an and Sunnah. Jurisprudential differences have also existed among the Companions, even the disagreements in administrative and experimental matters continued to occur in the Prophet's Majlis during the Prophet's timeIn the time of the Righteous Caliphs and the common Companions, apart from administrative matters, when new events occurred which were not explicitly mentioned in the Qur'an and Sunnah, or one verse of the Holy Qur'an apparently contradicted another verse or one hadith seemed to contradict another, So they reflected on the texts of the Qur'an and Sunnah and used their opinions to resolve the contradictions and to deduce the Shari'ah issues which led to their differences. Some of these personalities also differ in the partial conditions of sacred acts of worship such as adhan and prayer, even in such ambiguous and unspecified matters, the difference of opinion of the Companions is no secret. But this disagreement has never led to war, nor has anyone been declared mislead because of it, nor has it ever happened that one group has refused to pray behind the other.Islamic history has shown that there has been a humble difference of opinion among scholars in every age but for the past few decades, the trend of extremism among Muslims in this regard has increased an extraordinary extent. There is a need to put an end to this extremism in sectarian divisions.
